These Website Terms of Sale apply to all sales made from thatGypsy (“we” or “our”) Website. It is important that you read these Website Terms of Sale ("Terms of Sale") carefully before ordering any products from this Website ("Product(s)") and ensure you understand them. Together with our Security and Privacy policy and our below Terms of Use, they govern the relationship with you in relation to this Website and your purchase of Product(s) from this Website.

Please note that by placing an order (“Order”), you confirm that you agree to these Terms of Sale. Please understand that if you refuse to accept these Terms of Sale, you will not be able to order from this Website. We have the right to amend these Terms of Sale from time to time. However, each Contract will be subject to the Terms of Sale that were in force at the time of your Order, except to the extent that any change is required by law, regulation or governmental body.

ORDERING AND DELIVERY INFORMATION
- Please make sure the email address you provide is correct and your mailbox is in proper working order. All Order confirmations and acceptances are sent to that email address. Please check any spam folders you may have for Order communications.
- No Orders should be placed by persons under the age of 16.
- Whilst we try to ensure that all details (including prices) displayed on this Website are correct and up to date, we have various products on our Website. You must ensure that prior to placing an Order, you have checked all relevant details about the Products you have selected as their relevant details may have changed since you last visited this Website. Product prices shown on this Website may change from time to time, for example, if the Product you are ordering is subject to a promotional discount or offer which is either applied or withdrawn during the selling period.
- All Products displayed on this Website are subject to availability and all orders are subject to acceptance.
- Prices are inclusive of applicable sales taxes, delivery charges or other international taxes or duties
- Orders are submitted via the Website in the following way:
- Once you are ready to make a purchase, click on 'Add To Shopping Bag' to add the Product you wish to purchase to your Shopping Bag. Then proceed by clicking 'Checkout' to log into secure servers to complete your Order.
- You will be asked for your email address to proceed. At this point, you do not have to create an account with us but you are required to provide an email address to process your Order.
- If you have already registered with us you may enter your sign-in details to access your account.
- You will be required to enter your delivery and billing address details if this is your first Order or do not have an account. If you have an account, you can use the address details from your account or add a new delivery address. You will then be required to enter your payment details.
- We do not store payment details so you will need to enter these each time you place an Order.
- Before checking out, you must confirm you wish to make an Order and accept these Terms of Sale.
- Once you have completed your Order, you may create an account with us, which requires a password. You must keep this password confidential and must not disclose it or share it with anyone else. The address that you register with must be the address that your payment card statement is sent to, however you can use a different shipping address.
- Once you submit your Order, we will usually then send you a confirmation email to acknowledge that your Order has been received (“Confirmation”). Please note that the Confirmation does not constitute acceptance of the Order, and no contract for the sale of merchandise under the Order shall come into effect, until you are notified by email that we have dispatched the Merchandise to you. At this point a contract ("Contract") is formed and, depending on your payment method, your payment will be processed in accordance with these Terms of Sale using the payment details you have given to take payment for your Order.
- You will receive a further email confirming despatch of the Product(s) to the shipping address you have requested.
- You should check each email for accuracy and let us know immediately if there are any errors using the contact details above.
- When you submit your Order, you are offering to buy the Product(s) at the price set out in the Order. Prices are checked regularly. However, if we find the price has changed, or that there has been a pricing error when we receive your Order, we will contact you and ask if you wish to proceed at the correct price.
- If there are any problems with your Order (for example, we don’t have the products you wanted in stock, we can only fulfil part of your Order, or we find the price has changed), you will be contacted by a representative from the thatGypsy Customer Service.
- Please be advised that we are unable to rectify mistakes you have made on your Order so do check it carefully before checking out. Please see the section below for your rights to cancel.

PAYMENT
All website payments are processed by CCAvenue.
Accepted Payment Methods: You may pay via debit card, credit card or another alternative payment method specified as part of the checkout process. We may change the payment methods at any time but this will not affect any existing Order.

If you place an order on the Website, then you acknowledge and agree that:
CCAvenue will charge you through the payment method you have selected for your Order and such other amounts that may accrue in connection with the Order;
(ii) that you will provide valid and current information for (a) yourself and (b) if applicable, another person, but only if you have first obtained their express consent to do so;
that we may use tools, software or services of payment processors to process transactions on their behalf; if your payment is not received by us for any reason from your card issuer, you agree to promptly pay all amounts due upon request and using the method that we reasonably prescribes; and you may be charged bank or credit/debit card issuer with additional fees (such as foreign transaction fee or cross border fee) or surcharges imposed by your bank or credit/debit card issuer.

Prices are inclusive of applicable taxes

DELIVERY
Please see the Confirmation email sent to you for details of delivery times depending on your location.

PRODUCTS
- The images of the products on the Website are for illustrative purposes only. Although we make every effort to display the colours and product details accurately, we cannot guarantee that your computer’s display accurately reflects the products. Your products (including their labelling or packaging) may vary slightly from those images.
- Any products purchased are for non-commercial use or import, and must not be made available for re-export or resale.
- We regret that it is not currently possible to exchange a product bought on our Website.

Damaged or defective products
Each bag is handmade & intricately crafted by our artisans. Hence, each item will have slight variations in design & form; they are part of the product & not to be considered a defect. We apologize, if any product has been delivered to you damaged in transit. In this case, please email: customercare@thatgypsy.com and send pictures within 24 hours from delivery of the product. After review, an executive will get back to you with options for replacement of product.

Cancellation & Refunds
We regret that it is not currently possible to cancel a confirmed order or avail a refund of any item bought from our Website.

Disclaimer
We only supply products for private use.
Accordingly, to the fullest extent permitted by law, we shall not be liable to you for any loss of data, loss of profit or business interruption or for any business losses that you may incur as a consequence of our failure to comply with the Contract.
We shall not be responsible for any delay in, or failure of, performance of our obligations under these Terms of Sale arising from any event beyond our reasonable control and where we could not have taken appropriate steps to avoid such effects including third party telecommunication failures. This condition does not affect your legal rights.
If any event beyond our reasonable control takes place that affects our performance of our obligations we will notify you as soon as possible and our obligations under these Terms of Sale will be suspended and the time for performance extended for the duration of the event outside our reasonable control.
The checkout page may contain links to third party websites or services that are not owned or controlled by us. We are not affiliated with, have control over, and assume responsibility for the content, privacy policies, or practices of, any third-party websites. You:
are solely responsible and liable for your use of and linking to third party websites and any content that you may send or post to a third-party website; and
expressly release us from any and all liability arising from your use of any third-party website. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third-party website that you may choose to visit.

General
If any provision of these Terms of Sale is found to be invalid or unenforceable by a court, it will be deleted from the rest of these Terms of Sale, which shall remain unaffected.
No delay or failure by us to exercise any powers, rights or remedies under these Terms of Sale will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies prevent any other or further exercise of them.
The formation, existence, construction, performance, validity and all aspects whatsoever of these Terms of Sale or of any term of these Terms of Sale will be governed by the law of Mumbai, India.
